Permits, placement and who may haul in Proctor
Who may haul — the rule that matters: “No person shall engage in the business of collecting or removing garbage, rubbish, other mixed municipal solid waste and recyclable materials within the city without first obtaining a license to do so” (City Code § 50.04(A)), and only collectors with a valid collector's licence issued by the District may collect solid waste in the city (§ 50.04(B)). The Western Lake Superior Sanitary District, now called Resource Renew, says no one may collect or transport mixed municipal solid waste, rubbish or recyclable materials for profit within the District without a District licence (WLSSD Solid Waste Ordinance § 6.1), and its hauler application lists roll-off containers and construction/demolition waste among the services. We're licensed and insured.
In the street: no person may obstruct or excavate any right-of-way without first getting the appropriate permit from the City (§ 95.03(A)), and an obstruction permit is needed to hinder free and open passage by placing equipment (§ 95.03(A)(2)). The City's posted fee schedule lists no obstruction fee. Ask City Hall, 218-624-3641.
Winter: no parking of any motor vehicle on any street or alley from 2 a.m. to 7 a.m., November 15 to April 1 (§ 71.08). That rule covers vehicles and we found no container rule, but the street is where the plows work — driveway first. Give us clear placement instructions and you don't need to be home for the drop-off.
State highways: MnDOT has no permit for setting a private container on trunk-highway right-of-way, and Minnesota law makes it a misdemeanor to obstruct a highway or place any object within its limits (Minn. Stat. 160.2715). Beside a state highway the container goes on private property, never in the right-of-way. We check the exact address.
Covered loads: Minnesota bars driving a load that can drop, sift, leak or blow out (Minn. Stat. 169.81, subd. 5). Keep debris level with the top rim — overfilled containers can't be legally transported.
Remodel or tear-down: Minnesota requires appliances, tires, mercury items, batteries, oils, electronics and household hazardous waste to be taken out before renovation or demolition starts (Minn. R. 7035.0805). Demolition debris means concrete, brick, asphalt, untreated wood, masonry, glass and similar building parts — never asbestos (Minn. R. 7035.0300, subp. 30). Asbestos work needs an MDH-licensed contractor, who notifies the Minnesota Department of Health at least 5 calendar days ahead (Minn. Stat. 326.74); a homeowner working in their own single-family home is exempt from the licence (326.72). For many demolitions — commercial buildings and larger residential buildings — the MPCA must be notified 10 working days ahead. Asbestos never goes in our containers; tell us if you find any.
