Permits, placement and who may haul in Superior

Who may haul — the rule that matters: we found no City of Superior hauler or roll-off licence — the City Clerk's licence list has none, and the garbage chapter (Ch. 58) sets no hauler licence, fee or insurance rule. Wisconsin requires a DNR operating licence to run a solid waste collection or transportation service (Wis. Admin. Code NR 502.06(1)(b)), with some exemptions. The City collects household garbage itself, and we found no roll-off franchise. We're licensed and insured.

In the street: materials or obstructions in a street or right-of-way are a nuisance unless used under a permit from the Director of Public Works (City Code § 106-8(a)), and the City can remove them without notice at the owner's cost (§ 106-8(b)); using a street or alley for any other purpose needs a Director of Public Works permit (§ 106-4). The code doesn't name the permit, and we found no fee or lead time. Blocking part of a sidewalk needs a City Clerk permit, approved by the building inspector, for no more than three days — longer needs Common Council approval — with a certificate of insurance naming the City (§ 106-46).

Winter and parking: alternate-side parking runs all year in Superior, with a changeover every Sunday from 4 to 8 p.m. (§ 112-51(g)), and nothing may stay parked on a snow-emergency route during a declared emergency (§ 112-54). Those rules are written for vehicles, but a container in the street sits in the plow's path — driveway first. Give us clear placement instructions and you don't need to be home; plywood or boards under the contact points protect a driveway.

Truck routes: vehicles over 26,000 lb stay on the City's designated heavy traffic routes, with a reasonable deviation for deliveries (§ 112-33, Schedule P) — a roll-off truck takes the shortest way in.

Knocking a building down: razing any building in Superior needs a permit from the building inspector; work starts within 60 days, is completed within 30 days of starting, all debris is hauled away and nothing is burned on site (§ 34-152). Book the roll-offs before demo day.

State highways: WisDOT requires a permit to work in the right-of-way of an Interstate, US or state highway, and we found no container permit type. The City names E 2nd St (US 2 and 53), Belknap Street (US 2) and Tower Avenue (Hwy 35) as its main highways — beside those, the container goes on private property, never in the right-of-way.

Covered loads: Wisconsin bars driving a vehicle loaded so its contents can drop, sift, leak or escape (Wis. Stat. 348.10(2)), and so does Superior's code (§ 106-6). Superior also says garbage may not be piled above the top of the container (§ 58-8(b)) — keep debris level with the top rim.

Knocking something down: before any demolition or renovation, the building has to be inspected for asbestos (Wis. Admin. Code NR 447.06(1)). Regulated jobs need 10 working days' notice to the DNR (NR 447.07(3)(a)); a single, isolated house or building of four or fewer units is “typically exempt” from demolition notice, unless it is part of a DOT road, commercial or industrial, or urban-renewal project. The inspection still applies. Asbestos never goes in our containers.
