Permits, placement and who may haul in Duluth

Who may haul — the rule that matters: Duluth requires a City Garbage Collector License to engage in the business of collecting or removing solid waste or recyclables in the city (City Code § 24-9). Licences run May 1 to April 30 (§ 24-13), and vehicles or containers conveying solid waste must be completely closed except while loading or unloading (§ 24-15(a)). The Western Lake Superior Sanitary District, now called Resource Renew, says no one may collect or transport mixed municipal solid waste, rubbish or recyclable materials for profit within the District without a District licence (WLSSD Solid Waste Ordinance § 6.1), and its hauler application lists roll-off containers and construction/demolition waste among the services. We found no City franchise or organized collection. We're licensed and insured.

In the street: any roll-off in a Duluth street, alley or sidewalk needs an Obstruction Permit from the City Engineer (City Code § 45-15); the City's Engineering page names “roll-off boxes” among the activities it covers. Apply online through ePlace; questions to City Engineering, (218) 730-5200. Before issuing it, the City requires a $10,000 surety bond and liability insurance naming the City — if the contractor already has a bond and insurance on file with the City Engineer, the applicant doesn't need their own (§ 45-19). The fee is a base fee plus a charge for the area and days used, with extra for parking meters and no-parking signs (§ 45-17) — check the City's current fee schedule; starting before the permit is granted adds a penalty. A road closure needs the application at least 5 business days ahead. The permit card is posted at the container (§ 45-18), and the City Engineer can require barricades and warning devices (§ 45-22).

On your property: on multi-family, commercial and industrial sites, City zoning regulates where commercial containers sit, but exempts a temporary container for waste from an active building permit's demolition or construction, for up to 180 days (UDC § 50-26.3.A.2(c)). The UDC's storage-container definition also names roll-off containers (§ 50-20.6.C), and the code doesn't say how that applies to a debris box on a house driveway — so we check placement rules with you before delivery. Give us clear placement instructions and you don't need to be home; plywood or boards under the contact points protect a driveway.

Winter: Duluth snow emergencies are declared by 4 p.m. and take effect that evening, never on a Sunday, and parked cars move to the opposite side of the street (City Code § 33-97.1, § 33-97.5(c)); alternate-side parking changes over every Sunday, 4 to 8 p.m. (§ 33-97.8). Those rules are written for vehicles and we found no container rule, but a box in the street sits in the plow's path — another reason the driveway comes first.

Hours: no collections in a residential district before 7 a.m. on Saturday or before 6 a.m. on any other day (§ 24-20(a)). The phone is answered 24/7; home drop-offs, swaps and pickups are booked inside those hours.

State highways: I-35, US-53, MN-61 and MN-194 run through Duluth. MnDOT has no permit for a private container on trunk-highway right-of-way, and obstructing a highway or placing any object within its limits is a misdemeanor (Minn. Stat. 160.2715) — on those addresses the container goes on private property. We check the exact block.

Covered loads: Minnesota bars driving a load that can drop, sift, leak or blow out (Minn. Stat. 169.81, subd. 5). Keep debris level with the top rim — overfilled containers can't be legally transported.

Remodel or tear-down: Minnesota requires appliances, tires, mercury items, batteries, oils, electronics and household hazardous waste to be taken out before renovation or demolition starts (Minn. R. 7035.0805). Demolition debris means concrete, brick, asphalt, untreated wood, masonry, glass and similar building parts — never asbestos (Minn. R. 7035.0300, subp. 30). Asbestos work needs an MDH-licensed contractor, who notifies the Minnesota Department of Health at least 5 calendar days ahead (Minn. Stat. 326.74); a homeowner working in their own single-family home is exempt from the licence (326.72). For many demolitions — commercial buildings and larger residential buildings — the MPCA must be notified 10 working days ahead. Asbestos never goes in our containers; tell us if you find any.
